Welcome to ENSLIN APOSTILLE & NOTARY. These Terms of Service ("Terms") govern your access to and use of our website and the services we offer, including notarizations, apostilles, document legalization, translations, and related services. By accessing our website or engaging our services, you agree to abide by the following terms and conditions.

1. General Terms of Engagement

  • All Sales Are Final: Due to the nature of our services, all transactions are final. No refunds will be issued once services are rendered unless an error was made by ENSLIN APOSTILLE & NOTARY.

  • Correction of Notary Errors: In the event of a verified notarial error on our part, we will correct the issue at no additional cost, provided notification is received within 72 hours.

  • Fees & Payment: All service fees are listed transparently on our website or quoted in writing prior to engagement. Additional fees may apply for travel, complex documents, expedited service, or out-of-state processing. Payment is due at the time of service unless otherwise arranged.

  • Forms of Payment: We accept major credit cards, bank transfers, and digital payments. Checks may be accepted at our discretion.

2. Disclaimer

ENSLIN APOSTILLE & NOTARY is not a law firm and does not provide legal advice. We are not attorneys licensed to practice law in New York State or any other jurisdiction. We do not assist in interpreting legal documents or advising on legal matters. For legal guidance, consult with a licensed attorney.

3. Client Responsibilities

  • Clients are solely responsible for the accuracy and completeness of documents submitted for notarization, apostille, translation, or legalization.

  • Clients must verify all personal, legal, and jurisdictional requirements for their documents, including those required by receiving foreign agencies.

  • ENSLIN is not liable for errors originating from the client’s documentation or delays caused by third-party agencies.

4. Notary Services (In-Person & Remote)

  • Scheduling: Appointments are required for all services and must be confirmed at least 2 hours in advance.

  • Travel & Late Fees: Travel fees apply for mobile notary services. A 15-minute grace period is extended; late arrivals beyond this may be rescheduled or incur a fee.

  • Remote Online Notarization (RON):

    • RON appointments must be honored within a 10-minute grace period.

    • No-shows may be eligible for a 50% refund or 100% credit toward a future RON appointment.

    • Technical failures on our end will result in rescheduling or a full refund.

    • Valid ID and device access are required.

5. Apostille & Legalization Services

  • Document Requirements: Only original or certified documents are accepted. Clients are responsible for confirming the appropriate form and certification level required by the destination country.

  • Processing Timeframes: We provide an estimated timeline upon receipt of your documents, but are not liable for delays or rejections caused by government agencies or mailing services.

  • Out-of-State Apostilles: These may incur additional fees and processing time. We work with trusted state agents and couriers to expedite such requests.

  • Embassy Legalization: Available for non-Hague countries. Fees and processes vary and are quoted per request.

6. Translations

  • Translations are completed by certified language professionals.

  • Each translation includes a notarized Certificate of Accuracy.

  • Clients must confirm if additional legalization is needed for translated documents.

7. Electronic Notarization & Apostille (e-APP)

  • Availability depends on the laws of New York State and the receiving country.

  • The signer must have the required technology, including a working camera, microphone, internet connection, and a valid email.

  • Clients are responsible for confirming the acceptance of e-notarized and e-apostilled documents with their intended recipient.

8. Shipping, Delivery, and International Mail

  • ENSLIN ships via reputable carriers, but is not liable for delays, damage, or loss during transit.

  • Shipping costs are billed to the client and vary by destination and service level.

  • Clients are responsible for accurate delivery addresses and any customs, VAT, or import duties.

9. Privacy & Data Protection

  • We respect your privacy and only collect necessary data to fulfill your service request.

  • Client information is not shared or sold.

10. Service Refusal and Legal Compliance

We reserve the right to refuse service to any individual if a request appears fraudulent, unethical, or in violation of state/federal law. This includes incomplete identification, suspicious documents, or abusive behavior.

11. Limitation of Liability

By using our services, you agree to release ENSLIN APOSTILLE & NOTARY and its associates from liability for indirect, consequential, or incidental damages resulting from delays, errors not caused by us, or third-party actions. Our liability, if any, is limited to the value of the service fee paid.

12. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes shall be resolved through mediation or arbitration in New York County, unless otherwise required by law.

13. Modifications to Terms

We reserve the right to modify these Terms at any time without notice. Continued use of our services constitutes your acceptance of these changes.
